The DEA Attack on Delta 8 THC

The DEA has Overstepped their boundaries on the sale of Delta 8 THC, and we are fighting back.

What Exactly Happened?

Recently (Summer 2020), The DEA has been punishing companies for the sale of Delta 8 THC. They have been forcing said companies to take down their listings. Saying that the sale of Delta 8 is not allowed. This is simply uncalled for, and this is a good example of the Government stepping outside the boundaries of their power. The DEA exists only to enforce existing laws, not create new ones. The sale of Delta 8 was made Legal by the 2018 Farm Bill. For this reason, they have no right to try to tell companies what to do pertaining to the sale of Delta 8.

The 2018 Farm Bill

According to the 2018 Farm Bill, all sale of Hemp derivatives, cannabinoids, and isomers is 100% legal. Given that the amount of Delta 9 THC is under 0.3% and that they are naturally extracted. To put this into layman’s terms; The sale of Delta 8 THC is 100% legal as long as the amount of traditional THC in the product is under 0.3%. Generally, this was true, including here at Snapdragon Hemp.

It should be noted that some people like to ask about the Controlled Substances Act. They ask this simply because Delta 8 THC is listed. However, the 2018 Farm Bill has an amendment to the Controlled Substances Act which makes the sale of D8 THC, once again, legal.

Was our Delta 8 THC Product Legal?

The short answer? Yes, our product was 100% legal. This is because our Delta 8 THC was made 100% from the hemp plant and it had below 0.3% Delta 9 THC in it. That means, there was absolutely nothing wrong with the product we were selling! Nevertheless, now our customers who relied on this stuff every day for relief from mental illness, pain, or one of the other things that Delta 8 can help with, are stuck suffering waiting for us to be able to sell it again.  

In addition to this, what about in our State? We are based here in Chattanooga TN and again, the sale of Delta 8 THC is 100% legal. In fact, Tennessee follows the 2018 Farm Bill and has allowed the sale of Hemp and anything Hemp derived.
