I am a guest of Snapdragon Shop, LLC, a Tennessee limited liability company doing business as Snapdragon Hemp (“Snapdragon”), and its affiliates, parent companies, subsidiaries, present and former employees, owners, officers, members, managers, and partners (collectively, the “Released Parties”), and I acknowledge that I must follow certain rules and regulations and waive certain rights as a condition for admission into Snapdragon establishments as provided in this Release of Liability Waiver (“Agreement”).

Compliance with Laws

I acknowledge that I will follow all federal laws, Tennessee laws, and local rules and regulations within the municipality where Snapdragon operates, especially those related to controlled substances. I affirm that I am at least 21 years of age and will provide proof of such upon request by Snapdragon.

Right of Removal

I acknowledge that Snapdragon has the right to remove me from its premises for violating this Agreement. Furthermore, Snapdragon may seek my immediate removal where my actions present a safety risk to employees or other guests.

Medical Disclosure

I am in reasonable health and am not otherwise limited by either minor or serious mental or physical injury, disability, or illness that could potentially render me particularly susceptible to sickness, injury, or disability. I am aware of the risks involved in consuming cannabis-infused/hemp-derived products. I fully understand and accept every one of the risks associated with cannabis sickness, unanticipated allergic reactions, injuries, or over consumption.

Assumption of Risk

My presence in a Snapdragon store and consumption of its cannabis-infused/hemp-derived products are at my own risk. Accordingly, I agree to hold harmless Snapdragon on behalf of myself, my heirs, and my personal representatives, to fully discharge and release Snapdragon and the Released Parties, from all claims, actions, damages, liabilities, losses, costs, and expenses in any way arising out of, or resulting from, my presence in a Snapdragon store and consumption of cannabis-infused/hemp-derived products, including without limitation, all claims, actions, and liabilities for death, injury, loss or damage to me or anyone else, or to any property, regardless of whether or not such injury, loss or damage was caused by the negligence or willful conduct of Snapdragon or any of the Released Parties.

Acknowledgement and Waiver of Liability

I acknowledge Snapdragon is not responsible for any side effects from smoke inhalation, vapor inhalation, or consumption of cannabis-infused products, such as bodily injury, nausea, vomiting, or fainting. Furthermore, I acknowledge that Snapdragon is not responsible for any interaction that may take place with law enforcement or my employer after the consumption of Snapdragon products. This includes but is not limited to motor vehicle accidents or the inability to pass a drug test. I agree to waive on behalf of myself, my heirs, and my personal representatives, to fully discharge and release Snapdragon and the Released Parties from any and all claims involving my use of cannabis-infused/hemp-derived products purchased from Snapdragon.

Indemnification

I agree to indemnify and hold harmless Snapdragon and Released Parties from any third-party losses, damages, actions, suits, claims, judgments, settlements, awards, interest, penalties, expenses (including Attorney’s fees) and costs of any kind for any loss or damage arising out of my activity as a customer of Snapdragon.

No Representations by Company

Snapdragon will not be held responsible for any claims or testimonials regarding the medical efficacy of any Snapdragon products. The FDA (Food and Drug Administration) has not evaluated any of these statements, nor have the claims been confirmed by FDA-acknowledged research. Neither Snapdragon’s staff nor its products are intended to diagnose, cure, prevent, or treat any disease or medical condition. Please consult a physician before using or ingesting Snapdragon products.

Choice of Law

This Agreement is entered into in Hamilton County, Tennessee and any dispute arising out of this Agreement may only be brought in a court of competent jurisdiction in Hamilton County, Tennessee. Tennessee law governs this Agreement.

Acknowledgement of Full Understanding

I acknowledge that I have read this Agreement and accept it in its entirety. I acknowledge and agree that I have fully read, understood, and voluntarily enter into this Agreement. No oral agreements have been made regarding this Agreement.

Entirety of Agreement

This Agreement expresses the terms and conditions of my entrance to Snapdragon in its entirety, and amendments to this Agreement shall be void unless in writing and signed by both Parties.

Severability

If any part of this Agreement is found to be unenforceable, such unenforceability shall not affect the enforceability of the remainder of this Agreement.

Medical Treatment Release

In the unlikely event that I require medical attention, I give Snapdragon and its staff permission to call for emergency medical services, and I consent to any medical treatment that may be given to me should Snapdragon determine that I require medical assistance. I accept full responsibility for costs related to my medical treatment, including any transport costs, and I release Snapdragon from any type of liability for anything that may happen during my treatment or transport.

Signature

Without an electronically-signed copy of this Agreement, I may not be on the premises. My e-signature below represents my understanding of and acceptance of this Agreement. My signature is an Agreement to release Snapdragon and the Released Parties from any and all claims that can be released as a matter of law. A copy of this Agreement will be provided to me.
